Welcome to Anna Pikpik. The terms “we”, “us” and “our” refer to Anna Pikpik. We operate this website and store, including all related content, features, tools, products and services (the “Services”). The Services are hosted on Shopify, which enables us to sell our products to you.
These Terms of Service (“Terms”) govern your use of the Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

SECTION 1 – ELIGIBILITY AND USE OF THE SITE
By using the Services, you confirm that you are at least the age of majority in your country of residence or have permission from a legal guardian. You agree to provide accurate and complete information when placing orders and to keep your account details secure. You are responsible for all activity under your account.

SECTION 2 – PRODUCTS
We strive to display products as accurately as possible. However, colors, textures, size, and appearance may vary depending on screens, lighting, and device settings. Minor variations in color, texture, print placement, or dimensions inherent to textile production do not constitute defects.
All product descriptions, prices, and availability may change without notice. We reserve the right to limit quantities or discontinue products.

SECTION 3 – ORDERS AND CONTRACT FORMATION
Placing an order constitutes an offer to purchase. A contract is formed only when we confirm your order by email after payment has been processed.
We may refuse or cancel orders in cases of pricing errors, stock issues, suspected fraud, or legal restrictions. If an order is canceled after payment, a refund will be issued. We also reserve the right to refuse orders where delivery information is incomplete or where previous transactions indicate abusive or fraudulent behavior.
Your statutory consumer rights remain unaffected.

SECTION 4 – PRICES AND PAYMENTS
Prices are shown in euros (€). Where applicable, prices include legally required taxes. Shipping costs are calculated at checkout and are not included in product prices.
For deliveries outside the European Union, customs duties, import taxes, and any carrier handling or clearance fees may apply. These charges are determined by the destination country and are the sole responsibility of the customer. Anna Pikpik has no control over these fees and cannot predict their amount.
You agree to provide valid payment details and authorize us to charge the total order amount.

SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs processing, strikes, weather, or events beyond our control.
Risk of loss passes to you when the goods are delivered to you or to a person designated by you, in accordance with EU consumer law.
Please ensure your shipping address is correct and complete. We are not responsible for delays, losses, returns, or additional fees caused by incorrect or incomplete addresses.
If a parcel is refused, unclaimed, or returned due to unpaid customs charges or delivery issues attributable to the customer, any reshipping costs will be borne by the customer. Where applicable, we may deduct return shipping costs, carrier fees, and any non-refundable charges from the refund.

SECTION 6 – INTELLECTUAL PROPERTY & ART PROTECTION
All illustrations, patterns, textile designs, artworks, visual compositions, graphics, product photos, and creative elements displayed on this website are original creations of Anna Pikpik and constitute protected intellectual property under international copyright, design, and related rights laws.

Protection applies to the designs themselves regardless of medium. This includes, without limitation, any reproduction or adaptation of our works onto fabric, clothing, accessories, posters, prints, digital files, tattoos, DIY projects, home décor, or any other physical or digital surface.

Strictly prohibited without prior written authorization:
– Reproducing or redrawing our designs
– Printing our patterns on fabric or other materials
– Using our artwork for personal DIY or home printing
– Tattooing our designs or allowing them to be tattooed
– Creating derivative works or “inspired” variations
– Selling, reselling, sublicensing, or distributing our visuals
– Uploading, sharing, or storing our designs on any platform or marketplace

The purchase of a product does not transfer any intellectual property rights. You are buying a physical item only. No rights to reproduce, modify, digitize, scan, trace, or adapt the design are granted.

We actively monitor online platforms, social media, marketplaces, print-on-demand services, and manufacturing networks using automated detection tools and manual reviews to identify unauthorized use.

Any infringement, including small-scale or “personal” use, will be treated as a commercial violation. Unauthorized users expose themselves to:
– Immediate cease-and-desist actions
– Formal takedown procedures across platforms and hosting services
– Claims for financial damages and legal costs
– International enforcement procedures where applicable

Infringement does not require identical copying. Substantially similar adaptations, color variations, mirrored versions, traced elements, or partial uses of our designs constitute violations.

We invest significant creative and financial resources into the development of our works and enforce our rights consistently and without exception.

Use of this website or purchase of our products does not grant permission to use our designs beyond personal ownership of the physical item. Any other use requires a formal written license from Anna Pikpik.

USE OF FABRIC DESIGNS
Our fabrics are sold for personal use. Mass production, industrial manufacturing, print-on-demand reproduction, sublicensing, or use of our designs by commercial brands, manufacturers, or production partners is strictly prohibited without a written license.
The purchase of fabric does not grant rights to reproduce, digitize,
scan, modify, or commercially exploit the design itself.


INFRINGEMENT CONSEQUENCES
Unauthorized use of our designs exposes infringers to claims for statutory damages, compensation for economic and moral prejudice, legal costs, and injunctive relief in accordance with international copyright and design protection laws.

Legal action may be initiated without prior warning once infringement is identified. Online anonymity, small-scale use, or modification of the design does not exempt liability.

Manufacturers, printers, tattoo artists, and platforms that assist in the reproduction or distribution of infringing materials may also be held jointly liable.

Records of our creations, publication dates, and production files are retained as evidence of authorship and priority rights.

SECTION 7 – THIRD-PARTY SERVICES AND LINKS
We may provide access to third-party tools or links. We are not responsible for third-party content, services, or policies. Use them at your own risk.

SECTION 8 – RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. All purchases are made directly with Anna Pikpik. Shopify is not responsible for sales transactions, products, or disputes between you and Anna Pikpik.

SECTION 9 – PRIVACY
Your personal data is processed in accordance with our Privacy Policy and Shopify’s privacy practices.

SECTION 10 – FEEDBACK AND REVIEWS
If you submit reviews or feedback, you grant us a non-exclusive right to use them for business purposes. You confirm that your submissions do not violate any third-party rights.

SECTION 11 – ERRORS
We reserve the right to correct errors in pricing, descriptions, or availability and to cancel orders affected by such errors, with refund where applicable.

SECTION 12 – PROHIBITED USES
You may not use the Services unlawfully, infringe intellectual property, transmit malware, harass others, scrape data, or interfere with the security of the site.

SECTION 13 – TERMINATION
We may suspend or terminate access to the Services if you violate these Terms.

SECTION 14 – LIABILITY
Nothing in these Terms limits mandatory consumer rights under EU or French law.
We are liable for damages caused by our fault as provided by law. We are not liable for indirect or unforeseeable damages to the extent permitted by law. We shall not be liable for failure or delay in performance resulting from events beyond our reasonable control (force majeure).

SECTION 15 – SEVERABILITY
If any provision is found invalid, the remaining provisions remain in effect.

SECTION 16 – GOVERNING LAW
These Terms are governed by French law. If you are a consumer residing in the EU, you also benefit from mandatory protections of the laws of your country of residence.

We may update these Terms. The latest version will always be available on this page.
