These Conditions of Sale apply to all purchases made from Anna Pikpik through this website.

2. Products
Products offered for sale include fabrics, sewing materials, and related items. Product descriptions, photographs, and visuals are provided as accurately as possible. However, colors, textures, and appearance may vary depending on screens, lighting, and device settings.
All fabrics sold by the meter or cut from a roll are cut to order. In accordance with EU consumer law, custom-cut fabrics may be exempt from the right of withdrawal.
3. Prices
Prices are shown in euros (€) unless stated otherwise. Where applicable, prices include legally required taxes.
Shipping costs are calculated separately and displayed before order confirmation.
For deliveries outside the European Union, customs duties, import taxes, and carrier clearance fees may apply. These charges are determined by the destination country and are the sole responsibility of the customer.
4. Orders
Placing an order constitutes an offer to purchase. A contract of sale is formed only when Anna Pikpik confirms the order by email after payment has been successfully processed.
We reserve the right to refuse or cancel an order in cases of pricing errors, stock issues, suspected fraud, or legal restrictions. If an order is canceled after payment, a refund will be issued.
5. Payment
Payments are processed securely through Shopify and its authorized payment providers. Accepted payment methods are displayed at checkout.
The customer confirms that they are authorized to use the chosen payment method.
6. Shipping
Orders are prepared within 1 to 3 business days. Delivery times are estimates and are not guaranteed. Delays may occur due to carriers, customs, weather, or other factors beyond our control.

Risk of loss transfers to the customer once the goods are delivered to the customer or a person designated by them.
7. Right of Withdrawal (EU Consumers)
For most products, EU consumers have a 14-day right of withdrawal starting from the day the goods are received, without needing to provide a reason.
However, this right does not apply to goods made to the consumer’s specifications or clearly personalized, including fabrics cut to order.

8. Returns and Refunds
Returns are accepted under the conditions set out in the Refund & Return Policy. Items must be unused and in original condition. Buyers are responsible for return shipping costs unless the item is faulty.
9. Liability
Nothing in these Conditions limits mandatory consumer rights under EU or French law.
Anna Pikpik is liable for damages caused by fault as provided by law. We are not liable for indirect or unforeseeable damages.
10. Intellectual property
COMMERCIAL EXPLOITATION STRICTLY PROHIBITED
All textile designs, patterns, illustrations, visual compositions, graphic elements, and artistic works incorporated into Anna Pikpik products are original protected creations. They remain the exclusive intellectual property of Anna Pikpik and are protected worldwide under copyright, design rights, and related intellectual property laws.
The purchase of a product transfers ownership of the physical item only. No intellectual property rights are transferred, licensed, or implied. The buyer acquires no right to reproduce, adapt, digitize, scan, trace, modify, print, manufacture, distribute, or commercially exploit the design in any form or medium.
Strictly prohibited uses include, without limitation:
– Using our designs for the commercial production or resale of clothing, accessories, home décor, or any goods
– Small-scale, handmade, “independent”, craft-based, or hobby business resale
– Industrial manufacturing, workshop production, or subcontracted production
– Print-on-demand, dropshipping, or platform-based production services
– Scanning, photographing, redrawing, vectorizing, tracing, or digitizing our designs
– Creating embroidery files, digital patterns, repeat files, or production templates
– Reproducing our artwork through home printing, sublimation, screen printing, transfer printing, embroidery, or AI generation
– Using our visuals for branding, marketing, product decoration, or merchandising
– Commissioning third parties, factories, or service providers to reproduce or adapt our designs
Any commercial use, even limited, small-batch, handmade, or non-industrial, constitutes infringement unless a prior written license has been granted by Anna Pikpik.
Monitoring and Evidence
Anna Pikpik maintains dated creation archives, production files, and publication records as proof of authorship and priority rights. We actively monitor online marketplaces, social media platforms, print-on-demand services, and manufacturing networks using automated detection tools and manual review processes.
Enforcement
Unauthorized use may result in immediate legal action without prior notice, including cease-and-desist measures, formal takedown procedures, and claims for financial damages and legal costs. Infringement includes substantially similar adaptations, color variations, mirrored versions, traced elements, or partial uses of our designs.
Manufacturers, printers, tattoo artists, production partners, platforms, and intermediaries involved in reproducing or distributing infringing materials may be held jointly liable.
Purchasing our products with the intention to reproduce, commercialize, or exploit the design constitutes bad-faith use and a violation of these Terms of Sale.
11. Governing Law
These Conditions of Sale are governed by French law. EU consumers also benefit from mandatory protections of the laws of their country of residence.
